1. Your Acceptance

  1. By using or visiting the BasifulGames website or any BasifulGames products, software, and interactive services provided to you on, from, or through the BasifulGames website (collectively the "Service") you signify your agreement to (1) these terms and conditions (the "Terms of Service"), (2) BasifulGames's Privacy Policy, found at https://www.basifulgames.com/privacy and incorporated herein by reference, and (3) BasifulGames's Community Guidelines, found at https://www.basifulgames.com/community_guidelines. If you do not agree to any of these terms or the Community Guidelines, please do not use the Service.
  2. Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version at https://www.basifulgames.com/terms. BasifulGames may, in its sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions.

2. Service

  1. The Service may contain links to third party websites that are not owned or controlled by BasifulGames. BasifulGames has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. By using the Service, you expressly relieve BasifulGames from any and all liability arising from your use of any third-party website.
  2. Accordingly, we encourage you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.

3. BasifulGames Accounts

  1. In order to access certain features of the Service, such as commenting, liking, or messaging, you will have to create a BasifulGames Account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify BasifulGames immediately of any breach of security or unauthorized use of your account.
  2. Although BasifulGames will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of BasifulGames or others due to such unauthorized use.

4. General Use of the Service—Permissions and Restrictions

BasifulGames hereby grants you permission to access and use the Service as set forth in these Terms of Service, provided that:

  1. You agree not to distribute in any medium any part of the Service or the Content without BasifulGames's prior written authorization, unless BasifulGames makes available the means for such distribution through functionality offered by the Service (such as the authorized Embeddable Player for trailers).
  2. You agree not to alter, modify, decompile, or reverse engineer any part of the Service, games, or software.
  3. You agree not to use the Service for any unauthorized commercial uses without BasifulGames's prior written approval, such as selling access to the Service or selling promotions inside user profiles or communication systems.
  4. If you use the Embeddable Player on your website, you may not modify, build upon, or block any portion or functionality of the Embeddable Player, including but not limited to links back to the BasifulGames website.
  5. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Service in a manner that sends more request messages to the BasifulGames servers in a given period of time than a human can reasonably produce. You agree not to collect or harvest any personally identifiable information, including account names, nor to use the communication systems provided by the Service (e.g., comments, direct messages) for any commercial solicitation or spam purposes.
  6. In your use of the Service, you will comply with all applicable laws.

5. Your Use of Content

  1. The Content on the Service, excluding User Submissions (such as comments or messages), and the trademarks, service marks and logos ("Marks"), are owned by or licensed to BasifulGames, subject to copyright and other intellectual property rights under the law.
  2. Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of BasifulGames.
  3. You agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content.

6. User Submissions and Conduct

  1. As a BasifulGames account holder you may submit textual content to the Service, including user comments and profile messages ("User Submissions"). You understand that BasifulGames does not guarantee any confidentiality with respect to any User Submissions.
  2. You shall be solely responsible for your own User Submissions and the consequences of posting them. You affirm, represent, and warrant that you own or have the necessary licenses and rights to post the content you submit, and that it does not infringe third-party intellectual property or privacy rights.
  3. By submitting User Submissions to BasifulGames, you hereby grant BasifulGames a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, and display such comments/messages in connection with the operation of the Service. You also grant each user of the Service a non-exclusive license to access and view your public comments through the Service.
  4. You agree that you will not submit any content or text that is contrary to the BasifulGames Community Guidelines, found at https://www.basifulgames.com/community_guidelines, or contrary to applicable laws and regulations.
  5. BasifulGames does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and expressly disclaims any and all liability in connection with user-generated text. BasifulGames reserves the right to remove any content without prior notice.

7. Account Termination Policy

  1. BasifulGames will terminate a user's access to the Service, including account deletion or temporary/permanent bans, if the user violates these Terms of Service or the Community Guidelines, or is determined to be a repeat offender.
  2. BasifulGames reserves the right to decide whether User Submissions violate these Terms of Service for reasons such as, but not limited to, hate speech, harassment, pornography, obscenity, spam, or toxic behavior. BasifulGames may at any time, without prior notice and in its sole discretion, remove such content and/or terminate a user's account for submitting such material.

8. Warranty Disclaimer and Limitation of Liability

YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, BASIFULGAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. BASIFULGAMES ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES OR DOWNLOADED GAMES, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY BUGS, VIRUSES, OR TROJAN HORSES TRANSMITTED BY THIRD PARTIES, AND/OR (V) ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY OR USER. THE RISK OF HARM OR DAMAGE RESTS ENTIRELY WITH YOU.

9. General

These Terms of Service shall be governed by applicable laws, without respect to conflict of laws principles. Any claim or dispute between you and BasifulGames shall be decided exclusively by a court of competent jurisdiction. These Terms of Service, together with the Privacy Notice and Community Guidelines, constitute the entire agreement between you and BasifulGames. If any provision is deemed invalid by a court, the remaining provisions shall remain in full force and effect. YOU AND BASIFULGAMES AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
